Effective Date: August 25, 2025

1. Purpose

These Terms and Conditions (the “Terms”) set forth the rights, obligations, and responsibilities of EMX Inc. (hereinafter the “Company”) and users in connection with the use of AI image generation services provided through the Company’s platform “Figure out” (hereinafter the “Platform”).

※ These Terms shall also apply, to the extent they are not contrary to the nature thereof, to electronic commerce conducted via PC communications, wireless networks, or other means.

2. Definitions

1. “Platform” refers to the virtual business space set up to allow transactions of goods or services through computers or other information and communications equipment, where AI image generation services are provided to users.
2. “User” refers to both members and non-members who access the Platform and receive services provided in accordance with these Terms.
3. “Member” means a person who has registered as a member of the Platform and who continuously uses the services provided.
4. “Non-member” means a person who uses the services without registering as a member.
5. “AI Image” refers to an image generated in various forms using AI technology based on photos uploaded by the user.

3. Display, Explanation, and Amendment of Terms

1. The Platform shall display these Terms, the name of the Company and its representative, business address (including the address for handling consumer complaints), telephone number, email address, business registration number, e-commerce registration number, and the name of the privacy officer on the initial screen (bottom section) so users can easily access such information.
2. Before a user agrees to these Terms, the Platform shall provide a separate link screen or pop-up screen so the user can confirm and understand important matters such as withdrawal of offers, liability for image generation, and refund conditions.
3. The Platform may amend these Terms to the extent that such amendments do not violate applicable laws.
